U.S. Rep. Bost: 'The American people, not activist judges, should decide the future of our country'

Mike Bost, representative for Illinois' 12th Congressional District, expressed his support for the No Rogue Rulings Act, aimed at curbing judicial overreach and preventing partisan judges from legislating from the bench. He conveyed this stance in a Facebook post on April 9.

"Time and again, activist judges have issued nationwide injunctions to obstruct President Trump's America First agenda – most recently attempting to halt the deportation of dangerous illegal immigrants while they were in the air leaving our country," said Bost, U.S. Representative, according to Facebook. "I voted for the No Rogue Rulings Act, which reins in judicial overreach and stops partisan judges from legislating from the bench. The American people, not activist judges, should decide the future of our country."

The No Rogue Rulings Act of 2025 was introduced by Representative Darrell Issa of California's 48th district on February 24. The legislation seeks to limit courts' authority to issue injunctive relief in two specific ways. Firstly, it stipulates that no U.S. district court shall issue injunctive relief except in cases where the order applies solely to the actions of the parties involved in the case and non-parties represented by those parties in a representative capacity.

According to The Hill, the second provision requires that if two or more states in different circuits challenge an executive branch action, the case must be referred to a panel of three randomly selected judges who are not chosen by the Chief Judge of the circuit. This panel may issue an injunction but must first consider factors such as justice interests, potential irreparable harm to non-parties, and maintaining separation of powers before deciding whether to grant the injunction.

This legislative move is reportedly driven by U.S. District Court Judge James Boasberg’s decision to temporarily block the Trump administration from deporting Venezuelan nationals under the Alien Enemies Act. President Trump has called for Boasberg’s removal from his position. A similar bill has been introduced in the Senate by Republican Senator Chuck Grassley.

Bost has served as Illinois’ 12th District representative since January 6, 2015. A lifelong resident of Murphysboro, he has extensive experience in state politics, having served as House Republican Caucus Chair in the Illinois State House of Representatives for two decades. Additionally, Bost is a former member of the U.S. Marine Corps and worked at Bost Trucking Service for 24 years before joining the Murphysboro Fire Department after completing training at the University of Illinois’ Certified Firefighter II Academy in 1993.
