City of Anna City Council met Jan. 18.

Here are the minutes provided by the council:

The Anna City Council met in regular session at Anna City Hall at 5:02 p.m. The meeting was called to order by Mayor Steve Hartline. The roll call went as follows: Present were Commissioner Michael Bigler, Commissioner Bryan Miller, Commissioner Martha Ann Webb and Mayor Steve Hartline. Commissioner Kathy Bryan was absent.

Commissioner Webb previously submitted a correction to the minutes to City Administrator Dori Bigler.

A motion was made by Commissioner Webb and seconded by Commissioner Bigler that it be RESOLVED TO APPROVE THE JANUARY 4TH, 2022 ANNA CITY COUNCIL REGULAR SESSION MINUTES AS THE OFFICIAL MINUTES OF SAID MEETING WITH SAID CORRECTION. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.

Mayor Hartline started the public hearing and asked Administrator Dori Bigler to speak. Administrator Bigler introduced Kevin Wills of Bernardi Securities. Mr. Wills explained that the city isn’t doing anything further at this point but satisfying the statutory requirements so that the city can go further. At this time, if the public has any comments, if any comments were previously submitted or if the council has any questions or comments, they are to be read or to speak now. Mayor Hartline opened the floor to any comments or concerns from the public. Administrator Bigler informed the council that no comments were previously submitted. Mr. Wills explained that the council has 3 years to act on issuing bonds. No comments or questions were received from the public or the council.

A motion was made by Commissioner Bigler and seconded by Commissioner Webb that it be RESOLVED TO CLOSE THE PUBLIC HEARING AT 5:10P.M. ON JANUARY 18TH, 2022. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea.

Nay – none. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.

Eian Mull was on the agenda for public communications but was not present at the meeting.

Administrator Dori Bigler reported that there were no further project updates than what is on the agenda.

Administrator Dori Bigler gave a quick recap of Ordinance 2022-01. The updates to the ordinance from the version on the last agenda include removing a cap on licenses, the effective date is July 1, 2022 and the fee is prorated 50% in 2022. We will be giving the businesses a 5 month notice with a copy of the ordinance.

A motion was made by Commissioner Bigler and seconded by Commissioner Miller that it be RESOLVED TO APPROVE ORDINANCE 2022-01; REGULATING VIDEO GAMING IN THE CITY OF ANNA. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.

Discussion was held regarding approving the bills. Commissioner Miller asks that we pull the bill for the Law Office of John Foley. Commissioner Miller stated that earlier today he asked for the bill and until he gets them, he wants this invoice pulled and wants the information. Commissioner Bigler stated that if Commissioner Miller would attend the meetings, then he would know what the bills were about. Commissioner Bigler addressed Mayor Hartline and asked him to please tell Commissioner Miller that this isn’t the time for this and he can submit a FOIA. Mayor Hartline stated that he has spoken to Mr. Miller regarding his behavior, attendance, etc. Commissioner Bigler asked what the Mayor was doing about it; stating that he is a member of this council, just like Commissioner Webb, and they deserve to be filled in. Mayor Hartline stated that a meeting would need to be set up and he will fill Commissioner Bigler in on what he’s been doing the last two years regarding issues with Commissioner Miller. Commissioner Webb asked if she could be included in a meeting as well. Mayor Hartline stated that the City Administrator would take the lead and set these meetings up.

Administrator Dori Bigler commented that Commissioner Miller requested the bill and she sent the 11-page, itemized bill to him. Commissioner Miller stated that he would like to see four specific emails. City Attorney Foley commented that the bill is itemized and the question isn’t about the legal services provided, it is about the subject matter. He addressed Commissioner Miller and said if you want to know what that was about, it was about you, Commissioner Miller; and that Commissioner Bigler is correct, if Commissioner Miller was in attendance to these meetings, he would know what the subject matter was about. Administrator Dori Bigler stated that Commissioner Miller never stated what dates of emails he wanted to see, and she read his email aloud. Commissioner Miller stated that was right, he forgot to include the dates.

A motion was made by Commissioner Bigler and seconded by Commissioner Webb that it be RESOLVED TO APPROVE TO PAY THE BILLS. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Webb and Mayor Hartline voted yea. Commissioner Miller voted Nay. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.

Administrator Bigler asked if anyone was interested in attending the Union County Chamber Gala. Mayor Hartline said to please let Administrator Bigler know if you are interested so tickets can be purchased.

Discussion was held regarding the Intergovernmental Agreement with Union County Animal Control. Administrator Dori Bigler pointed out that the fee has gone up 185% in two years’ time. Administrator Bigler reached out to County Administrator Angie Johnson to inquire about the increase and wanted to share those reasons with the council. For reference the City’s portion was $7,033.42 in 2019, $11,286.32 in 2020 and $20,026.76 in 2021. Administrator Bigler inquired last year why it increase so much and was told it was the salary of the new PT Administrator and adding new staff. County Administrator Angie Johnson said that they now believe they have it staffed correctly and that accounts for a majority of the increase. They increased a PT Administrator to Full-time, hired a second ACO officer, increased the hours of the other ACO officer, hired a third tech, and minimum wage has increased again for 2022. Commissioner Webb commented on how animal control doesn’t pick up skunks, racoons or opossums. Mayor Hartline asked Chief Bryan Watkins for feedback. Chief Watkins stated that when the PD calls, they always come help. He stated that they don’t handle nondomestic animals, and they haven’t in the past as well, but they take a big burden off of our officers. Mayor Hartline directed Administrator Bigler to inform Ms. Johnson that the city would appreciate if the agreement was received further in advance next time. He also directed Administrator Bigler to inquire with the other towns in the agreement and ask what they think of the rate increase.

A motion was made by Commissioner Webb and seconded by Commissioner Miller that it be RESOLVED TO APPROVE RESOLUTION 2022-01; INTERGOVERNMENTAL AGREEMENT WITH UNION COUNTY ANIMAL CONTROL. A vote was taken upon the motion with the following results. Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Commissioner Bigler voted Nay. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.

The Last Change Agreement was tabled.

A motion was made by Commissioner Webb and seconded by Commissioner Miller that it be RESOLVED TO APPROVE THE ZONING PERMIT FOR DAWSON MONTFORD AT 1090 HICKORY LAKE DRIVE. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Miller and seconded by Commissioner Webb that it be RESOLVED TO ENTER INTO CLOSED SESSION TO DISCUSS PERSONNEL AT 5:36 PM. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bigler and seconded by Commissioner Webb that it be RESOLVED TO EXIT CLOSED SESSION AT 6:41 PM. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Webb and seconded by Commissioner Miller that it be RESOLVED TO APPROVE THE CLOSED SESSION MINUTES OF JANUARY 18,

2022 AS PREVIOUSLY READ AS THE OFFICIAL CLOSED SESSION MINUTES OF SAID MEETING. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bigler and seconded by Commissioner Webb that it be RESOLVED TO DENY THE LAST CHANCE AGREEMENT. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.

Mayor Hartline directed Administrator Bigler and Attorney Foley to get together and create a new last chance agreement with modifications that were discussed and present it for the agenda on February 1, 2022.

A motion was made by Commissioner Webb and seconded by Commissioner Miller that it be RESOLVED THAT THE REGULAR SESSION OF THE ANNA CITY COUNCIL MEETING OF JANUARY 18, 2022 BE ADJOURNED AT 6:47 PM. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Commissioner Bryan was absent. Mayor Hartline declared the motion carried.
