City of Anna City Council met July 21.

Here is the minutes provided by the council:

The Anna City Council met in regular session at Anna City Hall at 5:00 p.m. on July 21, 2020. The meeting was called to order by Mayor Steve Hartline. The roll call went as follows: Present were Commissioner Michael Bigler, Commissioner Kathy Bryan, Commissioner Bryan Miller, Commissioner Martha Ann Webb and Mayor Steve Hartline. None were absent.

A motion was made by Commissioner Webb and seconded by Commissioner Bryan that it be RESOLVED TO APPROVE THE JUNE 16, 2020 ANNA CITY COUNCIL REGULAR SESSION MINUTES AS THE OFFICIAL MINUTES OF SAID MEETING. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bryan and seconded by Commissioner Bigler that it be RESOLVED TO APPROVE THE JULY 7, 2020 ANNA CITY COUNCIL SPECIAL SESSION MINUTES AS THE OFFICIAL MINUTES OF SAID MEETING. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Webb and seconded by Commissioner Bryan that it be RESOLVED TO APPROVE THE JULY 7, 2020 ANNA CITY COUNCIL REGULAR SESSION MINUTES AS THE OFFICIAL MINUTES OF SAID MEETING. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay -- none. Mayor Hartline declared the motion carried.

Mr. Dylan Tate from Campanella Law Firm presented information regarding the property located at 426 E. Jefferson Street Trailer Court. Mr. Tale stated that his client Jerry Sayers would need to purchase new homes every ten years. He also stated that Mr. Sayers rents mostly to Section 8 Housing. They are requesting a

modification of the ordinance to not have an age restriction on the trailers. City

Attorney John Foley stated that all replacement trailer(s) have to be 10 years old or newer. Commissioner Bigler stated that Mr. Sayers had not seen the trailers he purchased and should inspect them himself. City Attorney Foley stated that the legal owner has to be involved in the process also. Mayor Hartline reiterated the condition of the mobile home park and requested that it be cleaned up. Mayor Hartline suggested that Mr. Tate take a look at what he is representing.

City Administrator Dori Bigler previously submitted project updates to the council. She stated that the Revenue number for May has been received and she will forward them to the council.

No updates regarding Coronavirus.

City Administrator Dori Bigler stated that she reviewed the Union County Animal Control Agreement and verified that Animal Control will retrieve hens that are left behind. She stated that the applications would be presented to council for final approval. Commissioner Miller questioned the concern of the neighbors. It was questioned if there is a limit on permits. Commissioner Webb questioned if the people that don't have enough property to receive a permit could sue the city.

Ordinance 2020-11; Permitting & Regulating the keeping of Chicken Hens by property owners was tabled.

A motion was made by Commissioner Bigler and seconded by Commissioner Bryan that it be RESOLVED TO APPROVE TO PAY ALL APPROVED BILLS. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

Discussion was held regarding a request for Casey's General Store for Curbside Beer Sales.

A motion was made by Mayor Hartline and seconded by Commissioner Miller that it be RESOLVED TO DENY CASEY'S GENERAL STORE REQUEST FOR CURBSIDE BEER SALES. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

City Administrator Dori Bigler present the information regarding the bids for demolition of property at 413 W. High, 306 N. Green, & 623 E. High. Three bids were received. The bids are as follow: Mott Excavating for $24,000, Chris Plott Construction for $21,500 and Jerod Toler for $19,000.

A motion was made by Commissioner Miller and seconded by Commissioner Bigler that it be RESOLVED TO APPROVE TO ACCEPT THE BID FROM JEROD TOLER IN THE AMOUNT OF $19,000 FOR DEMOLITION OF PROPERTY AT 413 W. HIGH, 306 N. GREEN, & 623 E. HIGH. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

City Administrator Dori Bigler present the information regarding the bids for the Sale of Property at 213 B Grand Ave. She stated that only one bid came from Rebecca Poole in the amount of $50.

A motion was made by Commissioner Bigler and seconded by Commissioner Webb that it be RESOLVED TO APPROVE TO ACCEPT THE BID FROM REBECCA POOLE IN THE AMOUNT OF $50.00 FOR THE SALE OF PROPERTY AT 213 B GRAND AVE.. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

Richard Howell from Clarida-Zeigler Engineering presented an agreement to employ their firm for the Water & Sewer Extension Project. Commissioner Bigler questioned the fees, Richard stated the city would pay for the design fees. Richard stated that an EPA Permit needs to be obtained and it could take awhile to receive. He also stated that there are issues with the easement that need to be addressed. City Administrator Dori Bigler stated that Senator Fowler's office will be scheduling a Zoom meeting to discuss the project. She stated that there is $150,000 in the Water & Sewer budget plus $25,000 in contingents. Commissioner Bryan stated the project could create 300 employment positions, plus construction jobs. Discussion was held regarding the Water Grant and the possibility of offering a 50/50 for sewer cost. Richard stated that he is currently doing a rate analysis for water and sewer. Mayor Hartline questioned the easement issues.

Discussion was held regarding handrails on W. Davie Street. Commissioner Bryan stated that she had sent the council pictures before tonight. She stated that the Anna Art Center is requesting handrails in front. Lee Hackney a representative of the Anna Art Center stated that she has been told they are within ADA Compliance. Richard Howell with Clarida-Zeigler explained that the area needs more room to fix the issue. Commissioner Bigler questioned the liability if we place the handrails. Mayor Hartline requested that Richard look at the issue and figure out the best way to fix the problem. Commissioner Webb suggested painting the areas with reflective paint until to a solution is found.

City Administrator Dori Bigler stated that she has allotted $50,000 in the budget for equipment. Chief Watkins explained the design of the Load Bearing Vest.

A motion was made by Commissioner Miller and seconded by Commissioner Webb that it be RESOLVED TO APPROVE CAPITAL EQUIPMENT FUNDS FOR THE PURCHASE OF 8 LOAD BEARING VEST FOR THE POLICE DEPARTMENT FOR $2858.65. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bryan and seconded by Commissioner Bigler that it be RESOLVED TO APPROVE TO AUTHORIZE A CHANGE ORDER NO.2 FOR $2361.00 FOR THE ANNA BUSINESS PARK ROAD. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay- none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bigler and seconded by Commissioner Webb that it be RESOLVED TO APPROVE RESOLUTION 2020-31; ADOPTING THE PREVAILING RATE OF WAGES FOR THE CITY OF ANNA AS OF JULY 2020. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bigler and seconded by Commissioner Bryan that it be RESOLVED TO APPROVE A BUILDING PERMIT TO STEPHEN HORNBEAK AT 326 S. MAIN STREET. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan,

Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

No discussion was held on the building permits for Jerry Sayers at 426 E. Jefferson Street.

A motion was made by Commissioner Bigler and seconded by Commissioner Miller that it be RESOLVED TO APPROVE A SIGN PERMIT TO LYLE WOODRUM FROM THE DAVIE SCHOOL INN AT 300 FREEMAN STREET. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bigler and seconded by Commissioner Bryan that it be RESOLVED TO APPROVE A PARK USAGE APPLICATION FOR GOIN SHOWIN IN SOUTHERN ILLINOIS YOUTH LIVESTOCK SHOW ON AUGUST 15, 2020 PENDING INSURANCE. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Mayor Hartline declared the motion carried.

Fire Chief Mike Dammerman reported the department had 14 fire calls in June and 11 for July as of today. He stated they have been working on organization of the department and applying for grants.

Police Chief Bryan Watkins reported that Code Enforcement is going well. City Administrator Dori Bigler stated that we are working the Non-Owner Occupier Ordinance in affect. She stated we are looking at an Inspection module through Locis. Commissioner Bryan questioned the cost. City Administrator Bigler stated it would be $2000 to purchase and a monthly fee.

A motion was made by Commissioner Miller and seconded by Commissioner Bryan that it be RESOLVED TO ENTER CLOSED SESSION TO DISCUSS PERSONNEL & PENDING LITIGATION. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bigler and seconded by Commissioner Miller that it be RESOLVED TO EXIT CLOSED SESSION. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Webb and seconded by Commissioner Bigler that it be RESOLVED TO APPROVE THE CLOSED SESSION MINUTES OF JULY 21, 2020 AS PREVIOUSLY READ AS THE OFFICIAL CLOSED SESSION MINUTES OF SAID MEETING. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Miller and seconded by Commissioner Bigler that it be RESOLVED THAT THE REGULAR SESSION OF THE ANNA CITY COUNCIL MEETING OF JULY 21, 2020 BE ADJOURNED AT 7:30 P.M. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline. voted yea. Nay - none. Mayor Hartline declared the motion carried.
