City of Anna City Council met May 19.

Here is the minutes provided by the council:

The Anna City Council met in regular session by teleconference at 5:00 p.m. The meeting was called to order by Mayor Steve Hartline. The roll call went as follows: Present were Commissioner Michael Bigler, Commissioner Kathy Bryan, Commissioner Bryan Miller, Commissioner Martha Ann Webb and Mayor Steve Hartline. None were absent.

Mayor Hartline requested that everyone on the teleconference state their name. Present was City Administrator Dori Bigler, Public Works Manager Gary Dahmer, City Attorney John Foley, Police Chief Brian Watkins, and Deputy City Clerk Tina Sadler.

A motion was made by Commissioner Bigler and seconded by Commissioner Bryan that it be RESOLVED TO APPROVE THE MAY 5, 2020 ANNA CITY COUNCIL SPECIAL SESSION MINUTES AS THE OFFICIAL MINUTES OF SAID MEETING. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

A previous motion on May 7, 2020 by email was made by Commissioner Miller and seconded by Commissioner Bryan that it be RESOLVED TO APPROVE THE MAY 5, 2020 ANNA CITY COUNCIL SPECIAL SESSION MINUTES AS THE OFFICIAL MINUTES OF SAID MEETING. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Mayor Hartline declared the motion carried.

A motion was inade by Commissioner Webb and seconded by Commissioner Miller that it be RESOLVED TO APPROVE THE MAY 5, 2020 ANNA CITY COUNCIL REGULAR SESSION MINUTES AS THE OFFICIAL MINUTES OF SAID MEETING. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

Jerry Sayers the owner of 426 E. Jefferson Trailer Court spoke regarding building permits to replace a few trailers. Mr. Sayers stated that he has purchased 9 mobile homes and intended to move them as the old trailers are torn down. He stated that he was told an ordinance regulating mobile homes was on the agenda tonight and would ask that his trailers be grandfathered in because they are older than 10 years. City Attorney John Foley stated that there could be a variance to the ordinance if passed. Commissioner Webb questioned the condition of the homes and requested pictures inside and out. Mr. Sayers stated he would get Archie Mays his property manager to supply the pictures. Commissioner Bigler questioned the plan for the remaining mobile homes, if they are to be improved or taken down and replaced. Mr. Sayer stated he has 15 mobile homes to remove of the 22 lots that are in the mobile home park, Mayor Hartline stated the council would discuss the issue at the next meeting

Mayor Hartline allowed Brendan Tolan from American Ice Cream to present his request for a peddler's permit. Mr. Tolan would like to operate an ice cream truck inside the city. Discussion was held regarding the current peddler's ordinance and permit being out of date. Mayor Hartline stated that the council and the city attorney would review and get back with him.

City Administrator Dori Bigler previously submitted project updates to the council. City Administrator Bigler stated that she has spoken to State Representative Terry Bryant regarding the flooding issue on Route 146 in front of McDonalds and Brad's Collision.

Discussion was held regarding Coronavirus. City Administrator Dori Bigler stated there weren't any new updates. Mayor Hartline questioned the precautions being taken to keep all employees safe. Public Works Manager Gary Dahmer stated everything is going well at the garage. Commissioner Bryan questioned if they will have the cemetery mowed and ready for Memorial Day.

A motion was made by Commissioner Webb and seconded by Commissioner Miller that it be RESOLVED TO APPROVE TO PAY ALL APPROVED BILLS. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bryan and seconded by Commissioner Bigler that it be RESOLVED TO APPROVE ORDINANCE 2020-08; ADOPTING A POLICY PROHIBITING SEXUAL HARASSMENT. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay- none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bigler and seconded by Commissioner Bryan that it be RESOLVED TO APPROVE TO AUTHORIZE CITY ADMINISTRATOR DORI BIGLER TO PURCHASE THE PROPERTIES AT 413 W. HIGH ST., 306 N. GREEN ST., AND 623 E. HIGH ST. FOR $810 EACH AND TO OBTAIN ASBESTOS SURVEY'S, THEN PLACE OUT FOR BIDS FOR DEMOLITION. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay -- none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Webb and seconded by Commissioner Miller that it be RESOLVED TO APPROVE TO AUTHORIZE CITY ADMINISTRATOR DORI BIGLER TO ENTER INTO AN AGREEMENT WITH CENTRAL STATE FIREWORKS FOR THE CITY 4TH OF JULY DISPLAY FOR $7500. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

Resolution 2020-24; Authorizing & Approving an Agreement to Employ Gary Dahmer as the Anna Public Works Manager was tabled.

Resolution 2020-25; Authorizing & Approving an Agreement to Employ Dori Bigler as the Anna City Administrator was tabled.

Resolution 2020-26; Authorizing & Approving an Agreement to Employ Bryan Watkins as the Anna Chief of Police was tabled.

City Administrator Dori Bigler stated that it is currently being discussed that the position of Fire Chief/Code Enforcement Officer be separated. They are proposing to have a Part-time Fire Chief, Part-time Assistant Fire Chief and 2 Lieutenants. Then placing the code enforcement in the police department which would allow for an eighth officer in the department. Chief Watkins feels the enforcement of violations should come from the police department and City Attorney John Foley agreed. City Administrator Dori Bigler stated that is why they are requesting to change the Part-time Salaries and this should bring the Fire department in under budget by about $27,000.

A motion was made by Commissioner Bigler and seconded by Commissioner Miller that it be RESOLVED TO APPROVE RESOLUTION 2020-27; AMENDING THE 2020-2021 PART-TIME SALARIES. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay – none. Mayor Hartline declared the motion carried.

Discussion was held regarding the mobile home park inside the City of Anna. City Attorney John Foley reviewed the City of Jonesboro's Code regulating mobile home and created one similar for Anna. Commissioner Webb questioned the home Mr. Sayer had already purchased and the 10 year or newer age limits. Mayor Hartline state we need to clean up these areas. Police Chief Bryan Watkins spoke about the conditions of trailer court and agreed on the age restrictions.

A motion was made by Commissioner Webb and seconded by Commissioner Miller that it be RESOLVED TO APPROVE ORDINANCE 2020-09; ADOPTING THE REGULATIONS FOR MANUFACTURED AND MOBILE HOMES. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried

A motion was made by Commissioner Webb and seconded by Commissioner Bryan that it be RESOLVED TO APPROVE A PROPERTY USAGE REQUEST TO UNION COUNTY CHAMBER OF COMMERCE FARMERS MARKET FROM MAY 19 TO OCTOBER 31, 2020 IN THE EAST DAVIE STREET PARKING LOT. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

Mayor Hartline presented a request for a General Retail Liquor License. Mr. Tapan Parekh presented information briefly describing the type of establishment he wishes to bring to Anna. Mayor Hartline requested that the council take it into consideration and it be placed on the June 2, 2020 agenda.

Commissioner Webb stated Homer Hawk praised the city for all their work at the Veterans Memorial at the 4-way stop. She stated that Homer is working on trying to place a sign on the pillars next to the P.A.W.S building. Mayor Hartline stated thal il belongs to the railroad and he has given Homer Hawk the information.

Commissioner Bigler stated that due to the COVID19 Pandemic, he feels that the city needs to consider a spending freeze. He stated that the city doesn't know how much sale tax revenue we will receive. Commissioner Bigler requested that City Administrator Dori Bigler provide the council with the details once they become available. City Administrator Bigler stated that March's sales tax report should be available soon.

Police Chief Watkins reported that he will have his statues reports to the council in June.

A motion was made by Commissioner Bryan and seconded by Commissioner Miller that it be RESOLVED TO ENTER CLOSED SESSION TO DISCUSS PERSONNEL & PENDING LITIGATION. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

Police Chief Bryan Watkins and Public Works Manager Gary Dahmer entered the meeting for personnel issues and exited at 6:48 p.m.

A motion was made by Commissioner Bryan and seconded by Commissioner Miller that it be RESOLVED TO EXIT CLOSED SESSION. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Webb and seconded by Commissioner Bryan that it be RESOLVED TO APPROVE THE CLOSED SESSION MINUTES OF MAY 19, 2020 AS PREVIOUSLY READ AS THE OFFICIAL CLOSED SESSION MINUTES OF SAID MEETING. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline voted yea. Nay - none. Mayor Hartline declared the motion carried.

A motion was made by Commissioner Bryan and seconded by Commissioner Miller that it be RESOLVED THAT THE REGULAR SESSION OF THE ANNA CITY COUNCIL MEETING OF MAY 19, 2020 BE ADJOURNED AT 7:22 P.M. A vote was taken upon the motion with the following results. Commissioner Bigler, Commissioner Bryan, Commissioner Miller, Commissioner Webb and Mayor Hartline. voted yea. Nay – none. Mayor Hartline declared the motion carried.
