Union County Board of Supervisors met Nov. 5.

The Union County Board of Supervisors met in Regular Session on Monday November 5, 2018. The meeting was called to order at 9:00 AM with the following members present: Ron Riley, Dennis Brown and Dale Cline.

AGENDA: Motion by Cline and seconded by Brown to approve the Agenda. All voting aye, motion carried.

MINUTES: Motion by Brown and seconded by Cline to approve the minutes from October 29, 2018. All voting aye, motion carried.

OPEN FORUM: Dan Waigand had concerns of a bridge that is closed and hopes the board has a plan to reopen.

ENGINEER: Union County Engineer, Zach Gunsolley, presented and discussed the weekly maintenance activity report. Clearing Agreement: Motion by Cline and seconded by Brown to approve the Clearing Agreement with Tim Dunphy that shall cover the following items of work as requested: Dozing tree and brush removal on the south side of 190th street starting at Lark Ave. All voting aye, motion carried.

SHERIFF: Motion by Brown and seconded by Cline to approve the hire of Thomas Jason Dunphy as a full-time jailer as recommended by Union County Sheriff Rick Piel. All voting aye, motion carried. Motion by Cline and seconded by Brown to approve the hire of Ryan Maitlen as Sheriff Deputy as recommend by Union County Sheriff Rick Piel. All voting aye, motion carried.

RESOLUTION #7 FY 18-19 SET PUBLIC HEARING FOR BONDING: Motion by Cline and seconded by Brown approve Resolution #7 FY 18-19 as follows: Resolution to fix a date for a public hearing on a General Obligation County Building and Refunding Loan Agreement WHEREAS, Union County (the “County”) previously issued its General Obligation County Purpose Bonds, Taxable Series 2009A, dated July 29, 2009 (the “2009A Bonds”); and WHEREAS, in the resolution authorizing the issuance of the 2009A Bonds, the County reserved the right to call for prepayment prior to maturity any or all of the 2009A Bonds maturing after June 1, 2018 (the “Callable 2009A Bonds”); and WHEREAS, Chapter 331 of the Code of Iowa authorizes counties with a population under 25,000 to enter into loan agreements and borrow money in an amount not to exceed $600,000, for the purpose of acquiring and improving buildings; and WHEREAS, the County has proposed to acquire and remodel a building for use by the County Human Services Department (the “County Building Project”) at a cost not to exceed $600,000; and WHEREAS, the Board of Supervisor of the County proposes to enter into a loan agreement (the “Loan Agreement”) in a principal amount not to exceed $2,350,000, pursuant to the provisions of Sections 331.402 and 331.441 of the Code of Iowa, for the essential county purposes of undertaking the County Building Project and of refunding the Callable 2009A Bonds; and WHEREAS, it is necessary to fix a date of meeting of the Board at which it is proposed to hold a hearing and take action to enter into the Loan Agreement and to give notice thereof as required by law; NOW, THEREFORE, Be It Resolved by the Board of Supervisors of Union County, Iowa, as follows: Section 1.This Board shall meet on November 19, 2018, at the County Board Room, Creston, Iowa, at 10:00 a.m., at which time and place a hearing will be held and proceedings will be instituted and action taken to enter into the Loan Agreement. Section 2 The County Auditor is hereby directed to give notice of the proposed action on the Loan Agreement, setting forth the amount and purpose thereof, the time when and place where the said meeting will be held, by publication at least once, not less than four (4) and not more than twenty (20) days before the meeting, in a legal newspaper of general circulation in the County, in substantially the following form:

NOTICE OF PROPOSED ACTION TO HOLD HEARING ON A LOAN AGREEMENT IN A PRINCIPAL AMOUNT NOT TO EXCEED $2,350,000 (General Obligation County Building and Refunding) The Board of Supervisors of Union County, Iowa, will meet on November 19, 2018, at the County Board Room, Creston, Iowa, at 10:00 a.m., for the purpose of holding a hearing and taking action to enter into a loan agreement (the “Loan Agreement”) in a principal amount not to exceed $2,350,000 for the essential county purposes of acquiring and remodeling a building for use by the County Human Services Department and of refunding the outstanding balance of the County’s General Obligation County Purpose Bonds, Taxable Series 2009A. The Loan Agreement is proposed to be entered into pursuant to authority contained in Sections 331.402 and 331.441 of the Code of Iowa. The Loan Agreement will constitute a general obligation of the County. At that time and place, oral or written objections may be filed or made to the proposal to enter into the Loan Agreement. After receiving objections, the County may determine to enter into the Loan Agreement, in which case, the decision will be final unless appealed to the District Court within fifteen (15) days thereafter. By order of the Board of Supervisors of Union County, Iowa. Section 3. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Passed and approved November 5, 2018. Roll call vote: Brown aye, Cline aye, Riley aye, motion carried.

ADJOURNMENT: There being no further business, the meeting was adjourned at 11:45am.
